Full Activity Title: Consultative Task Force for Revision of Georgia’s Law on Private Arbitration

Project Abstract

Following the land/real estate privatization in Georgia, disputes  between newly emerged  property owners became common. Dipute resolution at courts takes much time and money and therefore they are not considered the best way  for settling disputes. Private arbitration is an effective alternative to this effect. 

In 1997 the parliament of Georgia passed the Law on Private Arbitration, pursuant to which civil disputes between private persons could be settled through private arbitration. APLR became involved in the arbitration related issues and started the works for increasing public awareness on alternate ways of dispute resolution.

 

With the funding of World Learning APLR implements the project aimed at identification and formulation of desired changes to the Law on Arbitration, as well as at preparation of recommendations to enhance the use of this method of resolving disputes.

 

Through the Alternative Dispute Resolution Task Force, the coalition which involves the experts from all organizations interested in arbitration issues and is established within the scope of the project, APLR lobbies necessary legislative changes, develops a dialogue between coalition members and parliament representatives, identifies, discusses and prepares proposed amendments to the Law on Arbitration for submitting to the parliament. 

 

The project results provide better understanding of needs for the development of alternate way of dispute resolution  and contribute to the improvement of legislative environment in Georgia.
