Project Abstract:

To codify legal framework on state-owned properties and increase its efficiency, Parliament of Georgia passed the Law on State Property on July 21, 2010. As a result the system of state property management was simplified; some new rules for property privatization were laid down; several legislative acts governing this system were abolished and respective legal norms and standards were unified in one law.

As from enforcement of the new Law, developing detailed procedures for state property disposal and privatization; preparing guidelines for application of the law, subject-specific training of the employees of appropriate state agencies and providing respective information to the parties interested in state property acquisition became necessary.

The Ministry of Economy and Sustainable Development of Georgia, responsible institution for state property privatization, contracted Association for Protection of Landowners’ Rights for preparing relevant instructions for application of the Law on State Property and for training employees of its territorial agencies with respect to legislative changes.

Within the scope of aforementioned cooperation commentaries on the law is being written in plain and popular language. These commentaries explain in detail various aspects of the Law. In particular, instructions cover the rules for state property privatization through auctions, including electronic auctions; conditions for participating in auctions; forms of privatization of agricultural land remaining in state ownership; rules for leased and unused land privatization; rules and conditions for direct sale of state property; privatization of agricultural land falling within the forests, forms of other state property privatization, etc.

All actors on real estate markets will find above guidelines to be very beneficial for understanding their rights and obligations in selling or buying state properties, as well as for acquiring thorough knowledge of the procedures they have to undergo. Guidelines will be available through web-pages of the Ministry and APLR and will play an important role in increasing public awareness on privatization procedures.

Project implementation will also support capacity-building of the territorial agencies of the Ministry and increased professionalism of their employees.
